3. Mr. Henderson is unable to approve the proposal,

originally put forward by the late Governor, in connexion

with the negotiations on this subject which took place last

year (cf. Colonial Office letter No. 62847/29 of the 7th

October, 1929) that the agreement should be drawn as between

the Governments of China and of Hongkong. Lord Passfield

will no doubt agree that an instrument in that form would be

an anomaly.

4. Mr. Henderson would suggest for Lord Passfield's

consideration that Sir William Peel might be instructed to

refer to His Lordship the text of the agreement which he has

concluded with Mr. Maze, at the same time communicating a

copy thereof to His Majesty's Minister in China. Such

alterations of a formal character as might be required would

then be prepared in this Department, and Sir Miles Lampson

would be instructed, if this seemed the best course, formally

to negotiate and to conclude the agreement with the Chinese

Government in the ordinary manner.
